These terms apply to every survey, quotation and job carried out by Empire Roofing Bath, for homeowners, landlords and commercial clients across Bath and the surrounding area. They sit alongside the written quotation you receive for your job. If the quotation says something different from these terms about a specific point, the quotation wins for that job. Nothing here takes away the rights you have as a consumer under UK law, including the Consumer Rights Act 2015.
Who we are and how to reach us
Empire Roofing Bath is a roofing business serving Bath and the towns and villages within about 30 road miles of the city. We work from site to site and have no public premises or trade counter. For anything about these terms, a quotation or a job in progress, phone 01225 285181 or email info@empireroofingbath.co.uk. Formal notices under a contract should be sent by email so that both sides have a dated record.
Surveys and quotations
Our roof survey is free and puts you under no obligation. We look at the roof, record the condition in photographs, and talk you through each one. After the survey we send a fixed price in writing. That quotation sets out:
- the work we will carry out and the materials we will use;
- the price, and whether VAT is included;
- any scaffolding, access equipment or waste removal included in the price;
- the payment stages;
- how long the quotation remains open for acceptance.
A quotation is an offer. A contract is formed when you accept it in writing, by email, by message or by signing a copy. Prices on our website are typical national ranges published by third parties and are given for guidance only. They are not offers from us.
Your right to cancel
If you are a consumer and you agree the contract with us at your home, or at a distance by phone, email or online, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 normally give you a period to cancel without giving a reason. For a service contract it ends 14 days after the day the contract is made. To cancel, tell us clearly by email or in writing; you may use the model cancellation form we provide with your quotation, but you do not have to.
We start within the cancellation period only if you ask us to, in writing or by email. If you then cancel, you pay a proportionate amount for the work carried out up to the point you told us. Once the work is fully complete, you lose the right to cancel, provided you asked for the early start and acknowledged that you would lose it. The right to cancel does not apply where you have specifically asked us to visit to carry out urgent repairs or maintenance, such as an emergency make-safe. It still applies to any extra work agreed on that visit, and to goods other than the parts needed for the urgent repair.
Before work starts
We agree a start date with you once the quotation is accepted. Dates can move because of weather, scaffold availability or the progress of earlier jobs, and we will tell you as soon as a date has to change. Please let us know before work begins about anything that affects access, parking, pets, alarms, or people at home who may be affected by noise or dust.
Some roof work needs consent. Where the job is notifiable under the Building Regulations, the quotation says so, and we deal with the building control side, either through the council or through a registered building control approver. Planning permission and listed building consent remain the property owner's responsibility. We will explain what we think is likely to apply, but the decision rests with the planning authority, so check with B&NES planning or your own council before relying on it.
Hidden defects and changes to the work
A survey can only show what is visible and safely reachable. Once a covering is stripped, we sometimes find problems that could not be seen before, such as rotten rafter ends, decayed battens (the horizontal laths that carry each course of slates or tiles), a failed parapet gutter lining or loose stonework in a chimney. If that happens we stop that part of the job, show you photographs and explain the options. Extra work goes ahead only after you have agreed a written price for it. If you ask us to change the work, we will confirm any change in price and timing in writing before we carry it out.
Payment
The payment stages for your job are shown on the quotation. For larger jobs this may include a deposit to cover materials ordered specially for you, such as natural slate or lead. Payment is due on the dates or stages stated, and the final payment is due when the work is complete. If something in the finished work concerns you, tell us straight away so that we can look at it; you may hold back a fair amount that reflects the item in dispute, but the rest of the invoice remains payable.
For business customers, we may charge statutory interest on late payment under the Late Payment of Commercial Debts (Interest) Act 1998.
On site
We will carry out the work with reasonable care and skill, using the materials described in the quotation or an equivalent you have agreed to. We protect your property where it is practical to do so, keep the site as tidy as roofing work allows, and clear the site and take away our waste at the end. Scaffolding stays in place only for as long as the job needs it. We may use photographs of the work as part of our records for your job; we will ask before using any photograph for any other purpose.
Our guarantee and your legal rights
Our workmanship is covered by a written guarantee lasting ten years from completion. What it covers, what falls outside it and how to make a claim are set out on our guarantee page and in the certificate you receive at the end of the job. Materials also carry any warranty given by their manufacturer, which we pass on to you. The guarantee is in addition to your statutory rights. Under the Consumer Rights Act 2015 a service must be carried out with reasonable care and skill, and you can ask for it to be put right if it is not.
Liability
We are responsible for loss or damage that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the contract was made. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit. For business customers, we are not liable for loss of profit, loss of business or indirect loss.
Complaints and disputes
If something goes wrong, please tell us first so that we have the chance to put it right. Our complaints procedure explains the steps. These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute that cannot be settled between us.
These terms are a sound starting point for a UK service-area roofing business with no public premises. They are flagged for review: the operator should have them checked by a solicitor or other qualified legal adviser before relying on them.
